1. Scope
These terms govern your use of the websites agentdeck.eu and sailing.agentdeck.eu and everything offered on them: the published pages, the agent in the bottom-right corner and the callback request form. They apply to the extent you use the website, the agent or the callback form.
They do not govern the work we deliver for a client — configuring, running and supporting an agent. That is governed by the written agreement signed for the engagement, which takes precedence wherever the two differ.
If you meet an agent that we operate on behalf of a client — on the client’s website, in a messenger or on the phone — that client provides the agent and is responsible for what it says. These terms do not apply there; the client’s own terms and privacy policy do.
2. Who operates this website
AgentDeck is operated by Tim Melnyk und Amir Dohmosh GbR „AgentDeck“, a German civil-law partnership (Gesellschaft bürgerlichen Rechts) based in Munich. Contact details and the disclosures required by § 5 DDG are in the Legal Notice.
3. No contract is concluded through this website
The pages describe what AgentDeck does and what it costs. None of it is a binding offer. A contract comes about only through a written agreement or a quote we have signed — not by reading a page, booking a demo or writing to the agent.
Our services are aimed exclusively at businesses within the meaning of § 14 BGB (German Civil Code), not at consumers. If you book a demo, request a callback or tell the agent about a possible engagement, we assume you are doing so for a business. We may decline enquiries from consumers.
Published prices are starting prices and exclude VAT: the monthly fee starts at €250 for text channels, setup is quoted once per project, and voice minutes are metered by country. The figure that binds is the one in your quote.
4. The agent on this website
The agent you can open on this site is an AI system and a demonstration. You are writing to a computer program, not a person. It is configured on AgentDeck’s own published material and is there to show how the product behaves — not to give information you can rely on.
Its answers can be incomplete, out of date or wrong. Nothing it writes is legal, tax, medical or financial advice, and nothing it writes is a binding statement about price, scope or availability. Where it matters to your case, ask a person: info@agentdeck.eu.
What you do or refrain from doing on the basis of its answers is your own decision. For damage that results from relying on an answer from the agent without checking with us, we are liable only as set out in section 10.
The agent is not authorised to make statements, commitments or contracts on our behalf. Prices, discounts, deadlines or scope it mentions are non-binding examples. Content you extract from it through deliberate manipulation is not a statement by us.
Please do not type health data, credentials, payment details or anyone else’s personal data into it. It is a demo, and it needs none of that to answer.
5. Callback requests
The callback is made by our AI voice assistant, which identifies itself as an AI at the start of the call. If you request a callback, you confirm that the number is yours or that you are entitled to give it, and you consent to being called about that enquiry. You can withdraw that at any time by writing to info@agentdeck.eu. We do not use the number for anything else.
6. How you may use the site
You may read the site, link to it, and quote short passages with a visible attribution and a link.
You may not attack or overload the site or the systems behind it, circumvent access or rate limits, harvest content at a scale that burdens it, use it to distribute unlawful, misleading or infringing content, or attempt to make the agent produce such content. If you do, we may block your access to the agent and the callback form.
7. Intellectual property
The text, images, design and code of this website, and the AgentDeck name and mark, belong to us or our licensors. Reading the site grants no licence beyond the quoting and linking described above. Republishing whole pages, articles or the case study elsewhere needs our written permission — ask, and it is usually given.
8. Links and third-party services
Demo bookings run on Calendly, and some pages link to services we do not operate. We check a link when we publish it, but we have no continuing control over what it points to and take no responsibility for its content. The operator of the linked service is responsible for it.
9. Availability
We make an effort to keep the site up, and we do not promise that it will be. It may be unavailable because of maintenance, a fault or a cause outside our control, and published pages, prices and features may change or be withdrawn at any time. The agent and the callback are demonstrations, and we may switch them off at any time without notice.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and wherever the law permits no limitation.
For ordinary negligence we are liable only for breach of an obligation whose fulfilment makes proper use possible in the first place and on whose observance you may reasonably rely, and then only up to the foreseeable damage typical for this kind of use. Any further liability is excluded.
These limitations also apply to the personal liability of our partners, employees, representatives and agents.
11. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU, this does not deprive you of the mandatory protections of the law of your country of residence.
If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Munich.
These terms are available in German and English. If the two differ, the German version prevails.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Changes to these terms
We update these terms when the website or the services offered on it change. The version published on this page at the time you use the site applies; the date above says when it last changed.
13. Severability
Should a provision of these terms be or become invalid, the remaining provisions stay in force.
